Hier ist ein Vorschlag für Europäische Bürger um an Richter Robert C. Broomfield zu schreiben |
 |
Beispiel 1
Your honor,
For months, I have followed the death penalty case of Debra Jean Milke. It has made spectacular news within the European environment and has been presented in various forms.
I am just a normal citizen and do not know all the procedures in the United States Justice System. However, I am appalled as to how this case was handled from the very beginning, and that Debbie is sitting on death row for something that, in our understanding, she was railroaded in and had no proper defense.
How is it possible to convict someone to death on no tangible evidence and not provide the proper legal guidelines to assure an unbiased trial ? I believe in proper justice for PROVEN criminal conduct, but I cannot condone methods that lead to convicting someone to death on nothing else but hearsay evidence or mere speculations.
Your country, to us over here, has been the model democracy upholding human rights. How can you possibly fail in a case so obviously misrepresented ? By the grace of God, please let your conscience be your guide. In the courts, it appears not to be a matter of guilt or innocence; however, it is a matter of life or death in this case. You may want to think about whether you can live with the fact of deliberately sending a person to death and who, in fact, may be innocent based on numerous findings which had not been dealt with in the appeals courts.
May the Good Lord guide you along.
Very respectfully yours.

Second suggestion to use for European citizens to write to Judge Robert C. Broomfield, |
 |
Beispiel 2
Your honor,
Based on ever increasing and alarming news (here and abroad) about wrongful death sentences, we as citizens in the free world are becoming more and more concerned about a justice system which allows such a sentence without any substantial evidence.
Debra Jean Milke was sentenced to death on the uncorroborated statement of a single police officer, claiming in his police report that Debra had supposedly confessed to have wanted her only child killed. His interview with her was neither witnessed, taped or signed by Debra.
According to the records, officer Saldate has a history of falsifying and fabricating so-called confessions as well as having lied to Grand Juries in numerous previous cases. Such police work sheds serious doubt on his credibility.
Many honest and dedicated police officers who take their profession seriously and oftentimes have to pay with their own lives in the line of duty, are being ridiculed by the proverbial "bad apple" amongst them. It is also no secret that he needed to solve this case "quickly" to proceed with his own career.
The entire proceedings during Debra Milke's trial do not show any tangible evidence that she had anything to do with the murder of her son and are less than convincing as to her guilt. Thereby alone, her constitutional rights have been gravely violated.
At present, it rests in your hands and on your conscience to at least provide a chance for a new and fair trial. One wrongfully executed person is one too many.
Very respectfully yours,

Your honor,
For more than 9 years, Debra Jean Milke is imprisoned in Perryville/Arizona awaiting her execution.
During the entire investigative phase, during trial and until sentencing, I cannot find anything factual evidence whatsoever linking Debra to this crime. Initially, she was represented by a public defender who obviously prejudiced his client's rights by lacking the competence and surely monetary means to handle such a high profile case properly. There is no forensic evidence and the entire case rests solely on an alleged confession to a police detective with questionable background as well as character assassination. Debra has adamantly denied ever having made a confession or signed any document, yet such police tactics were permitted at the time of the trial which, I understand, are no longer permitted.
Her meanwhile private attorney and investigator have uncovered a long list of inconsistencies and downright falsehoods, which the Supreme Court in Arizona has summarily denied to take into consideration.
I understand that further proceedings rest in your hands. I can only pray that the Federal Justice System is still adhering to the tenets of the United States Constitution. I am appealing to your personal and professional honor as a human being to evaluate Debra's case with moral conscience. The least I am asking for is a new and fair trial.
Very respectfully yours,

Your honor,
We are shocked at the verdict, Debra Jean Milke, received. All publicly accessible documentation as well as in-depth investigations of highly respected professionals and journalists show no evidence beyond reasonable doubt that Debra had anything to do with the murder of her only child.
However, it appears very obvious that she was a victim of a set of circumstances (extensive provocative media coverage from the day of her arrest, no competent legal counsel, a police and prosecutorial conspiracy to WIN this case - regardless of guilt or innocence or justice in general).
It is unbelievable that poisoning of the mind through media hype and their "cut and paste" style of influencing potential jurors can still be the basis for a fair investigation and trial, especially in a State of an extremely conservative mindset.
It is your task, Your Honor, to protect the tenets of the Constitution and to make sure that no innocent person is wrongfully convicted. Let us hope and pray that the Federal Justice System is still intact and inviolable of ulterior motives. We would like to trust in your personal integrity and your commitment to fair justice. It is, after all, a matter of life or death for a fellow human being.
Very respectfully yours,

Your honor,
The Debra Jean Milke case has caused tremendous outrage throughout the western civilized word, based on the documented facts, which have become public knowledge.
Most of the world has learned from wrongful justice applied and what it has caused eventually.
It is inconceivable for any educated and law-abiding citizen, that totally uncorroborated "evidence" of one single police detective with known personal ambitions and a record of having lied in many other cases can result to put a person on death row. Many other issues have been raised in this case during trial, but it is obvious that none of them could have held up as solid evidence. The State resorted to compound motives to make sure to impress the jury which, by the way, was selected under highly questionable tactics by the presiding judge.
Debra Jean Milke most certainly did not receive a fair trial as prescribed by the American Constitution.
The general public is in dire need to believe in some sort of integrity and proper justice. If the State of Arizona cannot provide, then you can.
Based on the fact that the only witness at the Grand Jury Hearing on Dec. 8, 1989 was former police officer Saldate and Debra was not even represented, it should have never even come to an indictment. But who protects the uninformed or normal everyday citizen ? It is in your hands and your conscience, Your Honor.
Very respectfully yours,

Dear Mrs. Napolitano,
Based on the obviously unfair trial circumstances of Debra Jean Milke, I (we) would like to urge you to not prosecute this case any further. To admit error would be a courageous, but the only moral step. You have "inherited" this case and I (we) would like to believe in your personal courage and integrity as a human being. Your public office demands from you to uphold justice in your state. I am (we are) not asking you to compromise your office and beliefs, but proper justice applied should still be the first and foremost issue to credit you as an elected official with unbiased standards.
May your conscience be your guide.

Dear Mrs. Napolitano,
While it is not my intention to raise the issue of the pro and contra with regard to the death penalty, I would, however, like to urge you to personally review the merits in the case of Debra Jean Milke.
It is absolutely obvious that most factors raised in the recently publicized study of the Columbia University apply in the above case. There is not a shred of factual evidence, which would link Ms. Milke to the crime for which she was sentenced to death in a "rush trial". The entire case was based on personal speculations and
hearsay - just to list a few issues.
After your election into this high office, you have inherited this case and, most likely, it is being administered further by your staff attorneys. It is in your hands to take a personal look at pleadings. To admit judicial error would be courageous, but the only morally acceptable step in the Debra Milke case. Proper justice applied should be the first and foremost issue to give credence to you as an elected official with unbiased standards.
May your conscience be your guide.

Dear Mrs. Napolitano,
The "model democracy" of the world and especially its judicial system applied in various states does no longer fit this role.
I would like to bring to your attention a case in your own
state - Debra Jean Milke - sentenced to death under circumstances, which decry anything close to a fair trial. Not a shred of factual evidence links Ms. Milke to this crime and many occurrences point to the fact that it was a "set-up" from the very beginning, a "win-at-all costs" situation for the prosecution against an almost non-existing defense. Juries convict on emotions and, in this case, this particular fact was more than obvious.
With all due respect, Mrs. Napolitano, you have it in your hands to review Ms. Milke's case personally. Your predecessor and his staff were biased. I would like to believe that your moral values and judicial concept differ inasmuch as it does not ignore the concept of "reasonable doubt" and is not tainted by political ambitions. I would like to beg you to have the courage to admit error and set a sign in the right direction.
Very respectfully yours,

Dear Mrs. Napolitano,
I cannot understand that Ms. Debbie Milke has been sentenced to death on no hard facts whatsoever. As a matter of fact, the entire handling of her case since her arrest almost eleven years ago strongly suggests that it was a "win at all cost" situation in the eyes of the State of Arizona.
I respectfully request that you in the highest official judicial position look into this matter personally and correct this deplorable error in justice.
I know that you were not responsible for the State's actions at the time Ms. Milke's arrest, trial, and sentencing. Therefore, I would like to think that you show responsibility and make absolutely sure that no innocent life is taken at the hands of the State.
May God guide your conscience,

Dear Mrs. Napolitano,
How is it possible for a person to be arrested and sentenced to death without any tangible evidence ?
Based on in depth research of this case by many accredited journalists, the facts surrounding Ms. Milke's case and conviction are shocking. I would like to strongly urge you to set an end to this travesty of so- called justice done.
Ms. Milke was pre-tried in the local media and it is a known fact that juries are being influenced by courtroom dramatics, especially when a not very competent public defender is pitched against a veteran prosecutor and a police detective who were shielded in their unethical methods by a judge, who was obviously biased and is facing charges herself for misconduct.
Latest information of the judicial system in the United States has produced an uproar world-wide. The findings in the Columbia University Study are appalling and most issues certainly apply to the Debbie Milke case.
I fervently hope that you exercise the necessary responsibility towards another human being.
With all due respect,

Dear Mrs. Napolitano,
The circumstances of Debbie Milke's conviction and death sentence are absolutely terrible.
A narrative police report without any backup material or signature as well as "hearsay upon hearsay" evidence and mere speculations are enough in your state to want to put a person to death ? I just cannot believe it. A prosecutor stating in court that "when I looked into her eyes, I saw consummate evil" with nothing else to substantiate his "feelings", however cleverly influencing a jury against an incompetent and underpaid public defender under time constraints is beyond comprehension !
I beg you to please do everything in your power to rectify this error.

Dear Mrs. Napolitano,
When, upon your election in 1998, you took your oath to uphold law and order in your state according to the Constitution, it also included the responsibility to protect the innocent from wrongful convictions.
One of the most blatant miscarriages of justice is the Debbie Milke case, which you were not responsible for at the time. I would like to beg you to use your moral integrity as a fellow human being to carefully look into this case yourself. Debbie was obviously "media tried and justice denied". You can help setting the right signals in a time where is it obvious that the U.S. justice system is making too many mistakes. Even one innocent person executed is one too many.
